Protected Action Ballots

Under the provisions of the Industrial Relations Act 1999, applications may be made to the Queensland Industrial Relations Commission (QIRC) seeking a ballot order for the conduct of a protected action ballot.

Protected action ballot applications must be lodged with the QIRC. Within 24 hours after lodgement of an application, the applicant must provide the Electoral Commission of Queensland with a copy. Applications can be sent by email (industrial@ecq.qld.gov.au), facsimile (07 3221 5387) or delivered by hand.

If the application is approved by the QIRC, it will issue a direction instructing the Electoral Commission of Queensland to conduct the ballot. All protected action ballots under the jurisdiction of QIRC are conducted by the Electoral Commission of Queensland.
